A few years ago, legislators at European level re-regulated this topic. Previously a 12-month warranty applied; in the new version this was extended to 2 years in order to better protect consumers with regard to defects. This statutory warranty applies EU-wide and is binding for all consumer goods. During the first 12 months the so-called reversal of the burden of proof applies, i.e. in the event of a complaint the manufacturer must be able to prove to the customer that the product was free of defects at the time of sale. After these 12 months, the burden of proof passes to the consumer, i.e. the buyer. They must then prove to the seller that the product was defective at the time of purchase.
